Buyer: An individual or legal entity who accepts this offer by paying for the Product.
1. Subject of the Offer
1.1. The Service Provider agrees to transfer digital goods — one or more photographs in electronic format (hereinafter referred to as the Product) — to the Buyer, and the Buyer agrees to pay for the Product under the terms of this offer.
1.2. Payment is made via the Robokassa payment service (https://robokassa.com). Payment confirmation is considered acceptance of the offer.
2. Order Process
2.1. The Buyer selects the Product on the website https://dariaignailph.com and places an order.
2.2. After successful payment via Robokassa, the following will be sent to the Buyer’s specified e-mail address:
- A download link for the Product;
- A license agreement (if applicable).
2.3. The Product is considered delivered once the link is sent. The Buyer is responsible for the safekeeping of the received data (e.g., not deleting the e-mail).
3. Price and Payment
3.1. Product prices are listed on the website. The Service Provider may change prices without notice.
3.2. Payment is made in Russian rubles via Robokassa (bank cards, e-wallets, and other available options).
3.3. Any payment system fees are paid by the Buyer.
4. License and Usage
4.1. The Product is provided under a non-exclusive license for personal, non-commercial use unless otherwise stated.
4.2. The following actions are prohibited:
- Reselling the Product;
- Using the Product for commercial purposes without written permission from the Service Provider;
- Uploading the Product to stock platforms or including it in NFT collections.
5. Refund Policy
5.1. Digital products are non-refundable (according to Article 26.1 of the Consumer Rights Protection Law).
5.2. Exceptions are made for technical payment errors (e.g., duplicate payments or non-receipt of the Product). In such cases, the Buyer must provide screenshots confirming the transaction.
6. Liability
6.1. The Service Provider is not liable for:
- Loss of the Product due to the Buyer’s fault (e.g., deleted email);
- Improper use of the Product in violation of the license terms.
6.2. The maximum liability of the Service Provider is a refund of the Product’s purchase price.
7. Privacy
The Buyer’s personal data is processed in accordance with the Privacy Policy (https://dariaignailph.com/privacy-policy).
8. Final Provisions
8.1. By making a payment, the Buyer confirms agreement with the terms of this offer.
8.2. Disputes shall be resolved amicably; if unresolved, they will be submitted to a court at the Service Provider’s place of registration.
8.3. This offer is valid indefinitely. The Service Provider reserves the right to make changes. The current version is available on the website.
